Ruku vs Toyota: The Whole Shebang!

So I haven’t touched on this in a while, simply because somehow, things got busy and I’ve found better things to do.

It’s okay, I’m as shocked as you are.

If you’re not one of my many adoring fans/friends and family/creepy internet stalkers who are on my Facebook friends list, I’ll fill you in on how I come to have a short scuffle with a motor company.

A while back now, Dave (friend and drinking buddy) sent me a picture over Twitter of a new Toyota vehicle they’re calling the “Rukus”:

At first, I thought “what a fucking stupid name for a car.” Then it clicked. That’s a fucking stupid name for anything. But damnit, That’s my fucking stupid name I’ve been using for all things internet since 2003.

Granted, Toyota was gracious enough to add an “s” on the end to avoid my knickers getting knotted further about the situation. I have a feeling that “Rukus” was meant to be pronounced “Ruckus”. which brings me to two further problems:

1) Whoever does the naming of cars at Toyota sucks at spelling

2) Would you really want to refer to your car as a “ruckus”?

Nevertheless, armed with nothing better to do, I sent off an email to Toyota:

To whom it may concern,

I have noticed recently that you have announced a vehicle you’ve named a “Rukus”. While I’m sure this is unintentional on your part, I have a concern that there will be confuson when it comes to online advertising, as I have been using ‘Ruku’ as my net handle since 2002-onwards.

Not to get all “I was here first”, but seriously, I totally was, and I have witnesses to prove it. So I’m sure you understand the situation here. If a name change isn’t feasible at this point, perhaps I could endorse the Rukus on my youTube channel on behalf of Toyota or something like that?

Thankyou for your time.

Naturally, being a big fancy motor company, you’d think they wouldn’t waste time on someone who clearly has way too much time on their hands. Having a night job does that to you. (in my defence, finished Bioshock 2 and Mass Effect within the same week. JUDGE NOT!)

You thought wrong. A few weeks after my initial email (at a point where I completely forgot about it), I got the following response:

Dear Mr Sheehan,

Thank for your recent email received by the Toyota Customer Experience Centre.

‘RUKUS’ is a registered trade mark owned by Toyota Motor Corporation in Japan, and used by Toyota Australia under an exclusive licence. Toyota Australia is comfortable with its rights to use this trade mark in Australia, and we are not infringing any intellectual property rights in doing so.

We also disagree that our use of the trade mark (primarily in relation to motor vehicles and relates products and services), will cause any confusion with your use of ‘Ruku’ in online advertising.

In relation to your request to endorse ‘RUKUS’ on your YouTube website, we do not permit third parties with no association with Toyota to use our trade marks as it undermines the significant investment TMCA and the Dealer network put into promoting and protecting the Toyota brand.

We thank you for your understanding.

Fair call I suppose. I can’t see myself selling cars under the RukuCorp(tm) brand anytime soon, so I guess there won’t be any trouble from my end. Though, I feel rather shafted I apparently can’t plug the vehicle on my YouTube channel. Ripped off much?

Then I got a little concerned. what if something does come up which might infringe their copyright? Sure, let’s face it. I’ve been known as Ruku since 2003 and I have people who can vouch that. But they own the trademark.

I sent the following reply. If we’re going to be sharing online and meatspace together, may as well play nice:

Thankyou for your reply. Just had one more question in regards to th ‘Rukus’ trademark. Should I be worried of any backlash from Toyota if I start making money via my use of ‘Ruku’ online? Or is it different enough to not cause any problems? I’m assuming so long as I stick to just being a self-centred angry internet blogger and don’t get into car manufacturing, I’ll be okay, right?

Not long afterwards, I recieve the following:


Dear Luke,

Whilst we appreciate your concern, it is really up to you to ensure you don’t infringe Toyota’s trade mark rights, and regrettably, we are unable give you legal advice regarding this matter.

As a guide though, trade mark owners such as Toyota can prevent third parties from using trade marks that are similar to our registered trade marks, if the third party uses the similar trade mark for similar goods or services.

You can obtain more information on this from IP Australia’s website, please find this information listed below:

http://www.ipaustralia.gov.au/trademarks/index.shtml.

In the instance you require any further information, we recommend that you obtain independent legal advice to ensure that you do not infringe.

So basically, they have full authority to shitcan me if I even dare using the name “Ruku” for “similar goods or services”.

Um, what? I’ve been calling my car the Rukumobile for months now, and it sure as hell doesn’t look like something that was designed on “Take your kids to work day”.

Seriously...

So basically, we’ve learnt from this that Toyota are just like any corporation: Arseholes. Thankfully. I think I’ll be getting my own back in the near future:

Michael Buckley/BuckHollywood

Michael’s the host of the ‘What the Buck’ show, which focuses mostly on celeb gossip. He also has two other accounts (BuckNews and Peron75) which he also posts to.

Tessa Violet/MeekaKitty

‘Meekakitty”s channel could be easily described as a bastard child of skits, personal vlogging with a dash of some good old-fashioned randomness and editing trickery.

Nick/Arthur40TwoDent

Found this guy through Angry Aussie. He’s done travel vlogs, personal vlogs, reviews and music videos -Most notably, four very creative videos for the song “Drive” by Johnathan Coulton. Awesome stuff.

Wayne Gladstone/Gladstonew

Yeah, okay. If you know me, you saw this one coming from a mile off. Gladstone is the host of the hugely popular web show ‘Hate by Numbers’, a columnist for various comedy websites and the owner of the website Kafka Lives in Maine. While his channel is mostly HBN-related, there’s a few other gems in there worth watching.

M.A.Ludwig/JudeMaris

JudeMaris mostly dabbles in original music pieces and photo restoration, with the occasional personal blog for variety. Being a photoshop geek myself, I find her photoshop work really interesting. She also has a bunch of stuff over at her other channel, TheBlueOracle

Well, it’s nearing 2:30am and I have to pretend to have a day job tomorrow. So I’ll call it here. Be good, kiddies! Don’t make me come over there!

You guys know I have a web series, right?

Ok, so it’s still in production, but it’s happening. The concept of this is both exciting and fucking scary -with a bit of that freshly-peed-your-pants feeling of relief, warmth and slight burning sensation.

And to think that ‘Hell is Other People’ was an abandoned script still under the name ‘Housemates’, which I kept on my hard-drive and was written around the same time as a few other abandoned projects which I thought were complete drivel. Naturally, I kept it from everyone, thinking it wasn’t good enough.

The other projects I’m still positive will never see the light of day. Well, one or two might… But one step at a time.

I’ve always had a big interest in doing creative things. This interest pretty much overtook any aspirations of “getting a real job” I ever had, so much so that I’m pretty sure that so long as I had something else keeping me going, I could stay in shitty minimum wage jobs for the rest of my life. Perhaps not the standard definition of “suffering for one’s art”, but hell, being a ‘Nocturnal Shelf Technician’ doesn’t exactly pay the bills.

However, the hardest part was starting. Especially solo. While I’ve always been able to come up with ideas, fleshing them out was insanely difficult. Self described ‘words man’ or no, putting a fully realised idea onto a page may as well have been rocket science. My other problem was trying not to completely rip off the works of people I enjoy. While I have plenty of housemate horror stories of my own, the book and movie “He Died With a Felafel in His Hand” and the well-known Brit-com series “Spaced” was (and still is) a major influence. In fact, “Housemates: Episode One” I wrote with the following in mind:

“Like Spaced, but with the homage-o-meter turned up to 11″

Naturally, I eventually adopted my own Tim, Daisy, Mike and Brian. Though admittedly, quite a few people I know personally wouldn’t be left out in a slow-motion mock gunfight, or talking about the chaos theories involved in the “Star Wars” trilogy.

I eventually decided I didn’t like how much like “Spaced” it became, so like everything else I’ve written up to that point, the original episode one of ‘Hell is Other People’ was abandoned, along with an incomplete episode two.

That is, until a gorgeous Canadian lass by the nane of Diana came along and told me it wasn’t shit and to keep going with it. She pointed out where to bring in the funny, and take the funny and make it funnier. Once all was said and done, I showed it to a few other people who also gave it the thumbs up. Then I moved onto the later episodes until I had essentially, an almost fully realised “season”.

Months later, I’m organising the first official rehearsal for “Hell is Other People: Episode One”. While other people certainly had an input in it’s creation and by no means to I intend to discredit anyone on the production crew, but “Hell is Other People” wouldn’t exist as much more than an idea without Diana’s input. For that, I have the upmost gratitude, respect and lots of thank-yous for her and what she did.

Diana, if you’re reading, on behalf of the cast + crew, thankyou. I owe you big time.

Remember when I did that video diary series once? Where I shoved a camera in drunk people’s faces and somehow didn’t get shanked?

If not, I did. It was called “Where the fuck are my pants”, and it’ll never be on YouTube due to copyright issues. I will, however, chuck it on DVD for y’all upon request.

Anyway, I’m thinking of doing another one. This time with less drunk and more nerd.

The series I’m proposing will be called “Have Dice, Will Travel” and I’ll be making a nuisance of myself by going around to various gaming/geek conventions and pestering people attending and people involved in its setup. Asking stuff like “what started it? When did it start?” and so on.

Question is: Would that be interesting? Would people be into that?

Everyone liked the last one because they were in it, pretty much. If you have a bunch of randoms flitting about and being extremely nerdy, would it still garner some interest?

What say you, Internet?

Sorry about the hiatus, folks. Pesky real-life shit’s got in the way again.

So I don’t normally do shout-outs, purely because I

1) never update, and

2) don’t really have anyone to shout out to.

Today (or yesterday, had I remembered) is different. As an aquaintence of mine, Kitty Hawkins over at So Very Small has been nominated for a Glammy under the category of “Freedom Centre Youth Awards”

For those (like me) who don’t pay much attention, the Glammys is an community awards ceremony-type thing run by GLBTI group Pride WA.

From what I’ve seen and the conversations we’ve had on Facebook and the like, Kitty has done a fuckload of work supporting the Gay/Lesbian/Trans*/Intersex community and -not so suck up or anything, but frankly? she deserves this nomination for the hard work she’s done.

Kitty, if you’re reading. Best of luck and I hope you win! *thumbs up*

/Writings/ will be back on track soon. Have a lot to post as of late, just gotta wait till I’m clear of these two weeks. Sorry again for the delay!

So since I uploaded Gene Simmons’ mug, this little corner of the internet has been pretty neglected. I guess seeing his sheer ugliness made me lose my creative appetite.

It could also be the fact that I’ve been two parts busy and four parts lazy… But let’s ignore that for now.

To slowly adjust back into writing for an audience of spambots and the occasional person I send the link to, I thought it’d throw up a list of what I’ve been thoroughly enjoying on the series of tubes as of late.

Part One: Blogs

Bannable Offenses

This blog is written by one of the Game Master’s for Final Fantasy XI Online, known to his fans as [GM]Dave. Where any normal GM would assist the players where possible and do their job by the book, [GM]Dave takes the renegade cop approach and feeds the book to the very same dragon he feeds FFXI players to.

While it does tend to be more of a soapbox/blog for non-FFXI related things these days, it’s still a bloody hillarious read (doubly so if you actually play the game as you know where all the locations [GM]Dave mentions are and such) and hey, there’s the archives if you need your “retards being eaten by a dragon” fix.

Gear Diary

A fresh find while googling the hell out of applications for my Nokia N95. Gear Diary is a catch-all techie blog containing product reviews, news posts and other odds and ends run by Judie Lipsett. Most of these cover mobile phones and other portable devices from the looks of things, but they occasionally throw in other things to mix it up a little.

The aim behind Gear Diary is evident in its subheading: “Everyone can understand technology; Sometimes it takes a little translating”. While it doesn’t particularly explain things quite in layman’s terms, they do keep things pretty damn simple for anyone who aren’t up to date with their techno-jargon yet. Gear Diary may not revolutionize the whole e-Journalist scene, but it does it’s job pretty damn well.

Ready-Up!

Okay, this might be a little biased seeing as one of my good friends write for the site. But honestly, it has become one of the first places I go for some gaming love action. The articles available consist of both game reviews and commentary on all things pixel. Everything is well written and oftentimes a bit of humor is thrown in as well.

Probably one of the few people that everyone likes when he gets angry, AngryAussie’s youtube channel is equal parts “variety/travel videos” and “angry soapbox”, the latter mostly done under the guise of the character “Mr. Angry”. He also has a blog, locatedin my sidebar, or if you’re lazy, here on WordPress

That’s about it for now. If there’s any more I can find, I’ll make another entry. For now though, look forward to a roundup of some of the applications I’ve been checking out for Symbian OS/Nokia N95. Some new, some old, some I’ve probably already blogged about.
